Returns, exchanges and complaints
Serenissima j.d.o.o. on behalf of ASIAN SPICE store, enables its customers to return and exchange products within 14 days. If you are not satisfied with the product you ordered, you can return it with a refund of the full amount paid, including the delivery amount if it was charged (only for the return of the entire order). All returned products must be unused and unopened in their original packaging and with all supplied parts. Due to hygienic reasons, the store will not accept the return of products that have been opened and/or used in any case.
You bear the cost of shipping to our warehouse for products that you return or exchange independently (by mail or delivery service), except in the case of returning or replacing defective products when we bear all costs (exclusively by delivery service GLS or DPD.
The following rules must be followed when returning:
• Returns and exchanges must be agreed in advance
• Refunds will be made in accordance with the legal deadline of 14 days (ZZP), i.e. after we receive the product at the warehouse
• If you want a refund, a copy of the account card and the account number (IBAN) to which you want the refund to be made must be attached to the goods that qualify for the refund.
The right to unilaterally terminate the contract (excerpt from ZZP, Article 72)
You can unilaterally terminate the purchase agreement within 14 days without giving a reason.
In order to be able to exercise the right to unilaterally terminate this Agreement, you must notify us of your decision to unilaterally terminate the Agreement before the expiration of the deadline by means of an unequivocal statement sent by mail, or by electronic mail to xxx , in which you will state your name, address, phone number , fax or e-mail address, and you can also use the attached sample form for unilateral termination of the contract.
The deadline for unilateral termination is 14 days from the day when the goods that are the subject of the contract were handed over to you or to a third party designated by you, who is not the carrier.
If you unilaterally terminate the Agreement, we will refund the money we received from you, including delivery costs, without delay, and no later than within 14 days from the day we received your decision to unilaterally terminate the agreement, unless you have chosen a different type of delivery and which is not the cheapest standard delivery that we have offered.
The refund will be made in the same way you made the payment. In case you want a payment to your account, please attach the IBAN for the payment. In the event that you agree to another way of returning the amount paid, you do not bear any costs in relation to the return.
We can issue a refund only after the goods have been returned to us or after you provide us with proof that you sent the goods back to us.
It is considered that you have fulfilled your obligation on time if you send or hand over the goods to us, or to the person we are authorized to receive the goods (GLS/DPD), before the expiration of the aforementioned deadline. You must bear the direct costs of returning the goods yourself.
You are responsible for any reduction in the value of the goods resulting from the handling of the goods, except that which was necessary to determine the nature, characteristics and functionality of the goods.
We will send you the confirmation of receipt of the notice of unilateral termination of the contract by e-mail without delay.
Exclusion of the right to unilateral termination of the contract (excerpt from ZZP, Article 79)
The consumer does not have the right to unilaterally terminate the contract from this section if:
(1) The service contract was fully fulfilled by the trader, and the fulfillment began with the explicit prior consent of the consumer and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the contract from this section if the service is fully fulfilled.
(2) The subject of the contract is goods that are made according to the consumer's specifications or that are clearly adapted to the consumer
(3) The subject of the contract is easily perishable goods or goods that quickly expire
(4) The subject of the contract is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery
The consumer is obliged to bear the costs of returning the goods to the store in case he exercises his right to unilateral termination of the contract from Article 72 of the ZZP.
MATERIAL DEFECTS FOR WHICH THE SELLER IS RESPONSIBLE
(According to the Obligations Act, Official Gazette No. 5/05, 41/08 and 125/11, Articles 400 and 429)
Article 400.
(1) The seller is responsible for the material defects of the items that he had at the time of the transfer of risk to the buyer, regardless of whether he was aware of this.
(2) The seller is also responsible for those material defects that appear after the transfer of risk to the buyer if they are the result of a cause that existed before that.
(3) It is understood that a defect that appeared within six months of the transfer of risk existed at the time of the transfer of risk, unless the seller proves otherwise or the contrary arises from the nature of the matter or the nature of the defect.
ONLINE DISPUTE RESOLUTION
From February 15, 2016, all online retailers in the European Union will have to inform the consumer about the existence of a platform for online dispute resolution, as well as the possibility of using it. How does the new platform work?
The new platform of the European Commission for the resolution of disputes via the Internet will enable the resolution of disputes related to purchases both at home and abroad without the need for lengthy and expensive court proceedings. Consumers and traders will be able to use the platform for online disputes, and they will be able to file a complaint in any of the 23 official languages in the EU.
This is extremely important as it will help resolve cross-border disputes, especially when it involves parties living in different Member States and speaking different languages.
When consumers and traders file a complaint, dispute resolution bodies will act as mediators between the two parties to resolve the issue.
Once an agreement is reached on who will resolve the dispute, the platform automatically forwards the dispute to that body, which is required to resolve the dispute entirely over the Internet within 90 days.
